1. Acceptance of Terms

By accessing or using the TechTrust AutoSolutions platform, mobile applications, website at techtrustautosolutions.com, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Service Description

TechTrust AutoSolutions provides a cloud-based vehicle and fleet management platform that includes:

• GPS tracking: Real-time vehicle location monitoring and route history.
• Fuel analytics: Consumption tracking, cost analysis, and efficiency reports.
• Maintenance management: Scheduled and preventive maintenance tracking, service history, and alerts.
• Compliance tools: Driver safety scorecards, licence monitoring, and regulatory compliance support.
• Reporting: Customizable dashboards, cost reports, and fleet performance analytics.

3. Account Registration

To use certain features of the Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. TechTrust AutoSolutions is not liable for any loss resulting from unauthorized use of your account.

4. Subscription and Payment

4.1 Pricing

All prices are displayed in Canadian Dollars (CAD). Applicable taxes will be added at checkout, including:

• Ontario: Harmonized Sales Tax (HST) at the prevailing rate.
• Quebec: Goods and Services Tax (GST) plus Quebec Sales Tax (QST) at the prevailing rates.
• Other provinces: Applicable GST, HST, or PST as required by law.

4.2 Plans

• A free plan is available with limited features.
• Paid plans are billed monthly and provide access to advanced features.
• Paid plans include a 7-day free trial. You will not be charged until the trial period ends.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time through your account settings or by contacting us.
• Cancellation takes effect at the end of the current billing period.
• No refunds are provided for partial months or unused portions of a subscription period.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable Canadian federal, provincial, or municipal law.
• Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks.
• Interfere with or disrupt the integrity, performance, or availability of the Services.
• Upload or transmit viruses, malware, or any other malicious code.
• Reverse engineer, decompile, or disassemble any aspect of the Services.
• Use the Services to harass, abuse, or harm another person or entity.
• Resell, sublicence, or redistribute access to the Services without our written consent.

6. Intellectual Property

All content, software, designs, logos, trademarks, and other intellectual property associated with the Services are the exclusive property of TechTrust AutoSolutions or its licensors. These Terms do not grant you any ownership rights in our intellectual property.

You may not copy, modify, distribute, sell, or lease any part of the Services or included software, nor may you reverse engineer or attempt to extract the source code, unless applicable law expressly permits it.

7. Your Data

You retain all ownership rights to the data you submit through the Services ("Your Data"). By using the Services, you grant TechTrust AutoSolutions a limited licence to process Your Data solely as necessary to provide the Services.

• We process Your Data as described in our Privacy Policy.
• We do not sell your data.
• Upon termination of your account, you may request export of Your Data for up to 30 days. After that period, Your Data will be deleted in accordance with our data retention practices.

8. Limitation of Liability

To the maximum extent permitted by applicable Canadian law:

• TechTrust AutoSolutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Services.
• Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total fees paid by you to TechTrust AutoSolutions during the twelve (12) months immediately preceding the event giving rise to the claim.
• These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if TechTrust AutoSolutions has been advised of the possibility of such damages.

Some provinces do not allow the exclusion or limitation of certain damages. In such provinces, our liability shall be limited to the greatest extent permitted by law.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario.

10. Bilingual Clause

These Terms of Service are available in both English and French. In the event of any inconsistency or discrepancy between the English and French versions, neither version shall be deemed to prevail. Instead, the interpretation most favourable to the consumer shall apply, in accordance with the principles of Quebec consumer protection law.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide you with at least 30 days' notice via email or a prominent notice on the Services before the changes take effect. Your continued use of the Services after the effective date of modified Terms constitutes your acceptance of the changes.

If you do not agree to the modified Terms, you must discontinue use of the Services before the changes take effect.

12. Termination

We may suspend or terminate your access to the Services at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to other users, us, or third parties. Upon termination:

• Your right to access and use the Services will cease immediately.
• You may request export of Your Data within 30 days of termination.
• Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) will continue to apply.

13. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable Canadian law, TechTrust AutoSolutions disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. You use the Services at your own risk.
